What changed on 2026-10-12: VIP is now a monthly subscription that renews automatically until you cancel it in your App Store or Google Play account. The one-off 7-day pass is no longer sold. The VIP section below explains renewal, cancelling and your right of withdrawal. A new section at the end applies only to users who live in the United States.
Who provides BabyDuo
David Ammer, Austria — contact: support@ammerbrothers.at ("we"). These terms govern your use of the BabyDuo mobile app and its server. How we handle your data is described separately in our privacy policy.
What BabyDuo is
BabyDuo helps two people choose a baby name together: you swipe through a catalogue of names, your partner does the same, and names you both like become a match. Names, origins and statistics in the app are offered for orientation and entertainment. They are compiled from official statistics and public sources and may be incomplete or out of date — nothing in the app is legal advice about whether a name may be registered where you live. Naming rules are set by your local registry office, not by us.
Popularity figures in the app combine real likes with seeded values based on public name statistics; they are for orientation and are not a count of BabyDuo users.
Who may use it
You must be at least 16 years old to create an account. By registering you confirm that you are, and that the information you give us is correct.
Your account
You need an account to use the app. Keep your password to yourself; you are responsible for what happens under your account until you tell us it has been compromised. Use one account per person and give an email address you can actually receive mail at — an unconfirmed address cannot be used to sign in, and it is the only way we can send you a password reset. We may suspend or delete an account that breaches these terms, is used to harass someone, or is used to attack or automate against our service.
Names you suggest
You can add a name that is not in the catalogue. It is dealt only into your partner's deck — never to strangers, and never into the public catalogue. You keep whatever rights you have in what you submit and grant us only the limited permission needed to run the service: to store your suggestion and show it to the partner you are linked with. Do not submit anything unlawful, abusive, hateful, or designed to insult a real person; suggestions are capped per day to keep that manageable. We may remove a suggestion without notice, and every name you suggested is deleted along with your account.
Linking with a partner
Linking always takes both sides: entering someone's partner code sends a request, and only the owner of that code can accept it. Once linked, the names you suggest are dealt into your partner's deck — anonymously, so they swipe without knowing the name came from you. It is only when the two of you match on one that they are told you suggested it, and only while "Reveal my suggestions" is on in Settings. They also see your matches with them. Choose who you link with accordingly, and see the privacy policy for the full list.
Advertising
The free app is funded by ads, shown at limited points such as when your swipe energy runs out. In the European Economic Area you are asked for advertising consent first; you can change that choice at any time under Settings → Privacy → Privacy options. Details are in the privacy policy.
VIP
VIP removes ads and the swipe limit, and lets you suggest names without watching an ad. It is a subscription that renews automatically every month and is charged again each month until you cancel it. You cancel in your App Store or Google Play account's subscription settings, not in BabyDuo — while VIP runs, Settings › Manage subscription takes you there. Cancel at least 24 hours before the current month ends, or it renews for another month; after you cancel, VIP keeps running until the end of the month you have paid for. Deleting your BabyDuo account does not cancel the subscription. The price shown in the app is set and collected by Apple's App Store or Google Play, and your contract for the payment itself is with them — so refunds run through their processes, not ours. VIP belongs to the BabyDuo account that last bought or restored it. If VIP you paid for is not showing, tap Restore purchases on the VIP screen first, then write to us.
Right of withdrawal. VIP starts the moment it is granted, at your express request when you subscribe. As a consumer in the EU you can withdraw within 14 days of first subscribing: in the app, open Settings › Withdraw from contract and confirm. This works without signing in too — tap "Try it without an account" on the sign-in screen, then Settings. The app then takes you to the refund page of the store you subscribed through: Apple's Report a Problem page or Google Play's refund help, which you can also open directly. The store handles the refund. If you withdraw, you pay only for the days you already had VIP (§ 16 FAGG). A monthly renewal does not start a new withdrawal period. Your statutory warranty rights are unaffected: if VIP does not work, tell us and we will put it right; refunds always run through the store.
Availability
BabyDuo is offered as it is. We do not promise any particular uptime, and the service may be interrupted for maintenance, by problems at providers we depend on, or by your own connection. We may change features, and we may discontinue the app — if we discontinue it, we will give reasonable notice where we can, stop selling VIP and tell you to cancel your subscription in your App Store or Google Play account; your statutory rights for VIP time you paid for but could not use are unaffected.
Ending it
You can stop at any time by deleting your account in the app (Settings → Delete account), which removes your data as described in the privacy policy — deleting the account does not cancel a VIP subscription; cancel it in your store account. We may terminate your access for a serious or repeated breach of these terms; where the breach can be put right, we will normally ask you to put it right first.
Liability
We are liable without limitation for injury to life, body or health, and for damage caused intentionally or by gross negligence. For slight negligence we are liable only where an obligation essential to this agreement is breached, and then only for the damage typically foreseeable in a contract of this kind. Nothing here limits liability that cannot be limited by law, and your mandatory rights as a consumer are not affected.
Changes to these terms
We may update these terms — for example when a feature changes or the law does. The current version is always at this address and carries the date above.
When we change these terms, the app shows you the new version and what has changed. It applies to you once you accept it in the app. If you do not want to accept it, you can delete your account. A change never alters a VIP month you have already paid for: until it ends, you can keep using the app under the terms it was bought under.
Applicable law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in another EU or EEA state, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence. Please write to support@ammerbrothers.at first if something is wrong — most things are settled fastest by email.
If you live in the United States
This section applies only if you live in the United States, and to no one else. For you, it takes precedence over anything above that says otherwise, as far as the law that applies to your claim allows. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BABYDUO AND VIP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE SAME EXTENT, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, AND OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO BABYDUO IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR VIP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND USD 50. Nothing in this section limits our liability for injury to life, body or health, or for damage we cause intentionally or by gross negligence. Some states do not allow the exclusion of implied warranties or the limitation of certain damages, so parts of this section may not apply to you.
